May 2026 is shaping up to be one of the most regulation-heavy months the trucking industry has seen in years. I've been tracking this daily for my own fleet operations, and there's too much here to keep to myself. Here's your weekly breakdown.

🚨 ELD REPLACEMENT DEADLINE — June 2, 2026

HERO ELD was delisted April 2. If you're still running it, you have until June 2 to switch to a registered device. After April 14, you're already non-compliant. This is catching people at scale houses right now. Don't be one of them.

📋 PAPER MEDICAL CARDS ARE DONE

As of April 10, 2026, paper medical certificates are no longer accepted for CDL compliance anywhere. Your examiner now has to submit electronically to the National Registry. Carriers should be pulling it from your MVR, not relying on the card in your permit book. Texas is enforcing this hard already.

⚠️ FMCSA IS DROPPING 5 NEW RULES THIS MONTH

May is a rulemaking wave — ELD revisions, Clearinghouse changes, broker transparency round 2, autonomous truck inspection standards, and a new rule on female driver safety and harassment. If any of these affect you, watch the Federal Register.

🔍 CLEARINGHOUSE UPDATE

Over 200,000 CDL holders are currently in "prohibited" status. States are downgrading CDLs within 60 days of notification. If you haven't queried your own status recently, now is the time.

Heads up: Pay.gov is scheduled for maintenance tomorrow (May 9) from 8-11 PM ET. Don't try to buy Clearinghouse query plans during that window.

📉 CDL CRACKDOWN

FMCSA pulled ~3,000 training providers from the registry and has another ~4,500 under investigation. The non-domiciled CDL emergency rule has triggered an estimated 90,000+ CDL removals nationwide. California was told to pause their program or risk losing federal highway funding.

If you've hired anyone recently, re-verify their driver qualification files. If their training provider has been removed or is under investigation, that's a liability you need to know about.

💰 BROKER RULES TIGHTENED

New financial responsibility rules for brokers went into effect January 16. Tighter surety bond and trust fund requirements so carriers can actually collect on unpaid freight charges. Worth auditing your broker partners if you haven't already.

📊 FREIGHT MARKET

Some good news — spot and contract rates are finally climbing. Long-term contract rates are up ~8% since last fall. Reefer is strong on produce season, flatbed on construction and infrastructure. Diesel has surged to levels not seen since late 2022 though, so watch your margins.

The compliance enforcement itself (Clearinghouse, CDL crackdowns, English-language requirements) is materially pulling capacity off the road. If you're still running and compliant, you're in a stronger position than you were six months ago.

🏗️ STATE UPDATES

TEXAS: Paper medical certificates no longer accepted (April 10). Three new state laws expanded local police authority on overweight enforcement — fines range from $100 to $10,000.

OHIO: Max length increased to 95 ft on designated routes. New seasonal weight adjustment drops legal weight 25-35% during spring thaw.

CALIFORNIA: Non-domiciled CDL program on federal pause. Risk of losing federal highway funding if not corrected.

📉 BANKRUPTCY WATCH

A dozen+ small carriers and brokers filed Chapter 7/11 in late April. Bound Logistics (NJ, 57 trucks), Liberty Carriers, NAS Logistics, Golden Spirit Freight, and others. The carriers that survive this cycle will be the ones who stayed compliant and kept their CSA scores clean.
